Documentation Legal Center Account & Service Terms TenthLoop 10th Vantage Accessibility Solution Accessibility Tool Addendum

Accessibility Tool Addendum

This Accessibility Tool Addendum (“this Tool Addendum”) supplements and is incorporated into the Accessibility Solution Terms, and applies to Customers who install, activate, or use the Accessibility Tool (the “Tool”) made available through the Marketplace. This Tool Addendum is also subject to the applicable Service Terms Schedule governing the type of accessibility evaluation the Tool relies on. In the event of a conflict between this Tool Addendum and the Accessibility Solution Terms or the Account Terms, this Tool Addendum controls solely with respect to the Tool’s specific functionality described below.

1. SCOPE OF THIS ADDENDUM

The Tool provides automated accessibility remediation functionality, across the types of digital content, assets, and media for which Remediation Modules and Integration Targets are made available from time to time. This Tool Addendum governs that functionality exclusively. Where the same Connector or a related tool also supports non-accessibility capabilities (including but not limited to technical SEO or performance optimization), those capabilities are outside the scope of this Tool Addendum and are governed by their own applicable tool addendum.

2. TOOL ARCHITECTURE

The Tool is distributed as a connector (the “Connector”) that a Customer installs on its website, platform, application, or other digital environment (each, an “Integration Target”). The Connector is a Marketplace tool for purposes of the Account Terms.

Within the Connector, functionality is organized into discrete, independently operating remediation capabilities (each, a “Remediation Module”). Each Remediation Module (a) addresses a specific category of accessibility issue (for example, missing or inadequate aria-label attributes, missing image alternative text, or other attributes or conditions supported by the TenthLoop platform’s rules engine from time to time); (b) operates independently of every other Remediation Module, including for purposes of metering, credit consumption, enablement, and availability; and (c) is available for use only if it has been separately purchased by the Customer and is currently active in the Customer’s account settings for the Tool. A Remediation Module that has not been purchased, or that has been purchased but deactivated, will not process any operation, and no credits will be consumed in connection with it.

Leovoid may add, modify, deprecate, or retire individual Remediation Modules within the Tool over time without affecting the Customer’s rights or obligations with respect to any other Remediation Module.

3. SUPPORTED INTEGRATION TARGETS

The Tool supports installation across a range of Integration Targets, including WordPress-based websites (including common WordPress page-building and commerce environments such as Elementor, Gutenberg, and WooCommerce) and other content management, e-commerce, website-building, application, and content environments made available through the Marketplace. References in this Tool Addendum to “the Connector” apply equally regardless of the specific Integration Target through which it is installed.

4. INSTALLATION, ACCESS, AND AUTHORIZATION

By installing and activating the Connector on an Integration Target, the Customer authorizes Leovoid to (a) read the content, structure, and configuration of the Integration Target reasonably necessary to identify accessibility issues within the scope of the Customer’s active Remediation Modules; (b) generate and apply automated fixes, attribute injections, and related changes through the active Remediation Modules, as configured by the Customer; (c) communicate with the TenthLoop platform and its API to transmit requests, receive results, and process the foregoing; and (d) transmit usage and activity data necessary for credit tracking, billing, and reporting under the credit and billing provisions of the Account Terms.

Depending on the Integration Target, enabling the Connector may require the Customer to provide administrator-level login credentials or other authentication credentials for that Integration Target, in addition to or instead of an API-based connection. Where the Customer provides such credentials, the Customer represents that it has the authority to grant Leovoid the access described in this Section, and remains responsible for the accuracy of the credentials provided and for revoking or updating them as needed. Leovoid will store and use any such credentials solely as necessary to operate the Connector, subject to the security provisions of this Tool Addendum.

The Customer is solely responsible for having the rights necessary to install and operate the Connector on the relevant Integration Target. Where the Integration Target belongs to a client or other third party, the Customer must obtain that party’s authorization before activating the Connector, and remains responsible for the Connector’s use as between the Customer and that third party.

5. FUNCTION OF THE REMEDIATION MODULES

Each Remediation Module examines the applicable content of the Integration Target for elements that lack proper accessibility attributes or otherwise present an issue within that Module’s defined category, and applies Leovoid’s automated processing — which may include AI-based generation, rule-based logic, or other automated techniques supported by the platform — to generate and apply appropriate labels, attributes, or other corrections.

Remediation performed by the Tool is automated. Automated remediation has inherent limitations: not every accessibility issue can be resolved automatically, and results depend on factors including the Integration Target’s theme or template, custom code, and third-party components. In some cases, the Tool may identify an issue, or propose or partially apply a change, without fully resolving it; completing such an issue may require additional manual changes by the Customer or by a qualified professional. Use of the Tool does not guarantee that the Customer’s Integration Target will meet any accessibility standard (including WCAG 2.1 or 2.2) or comply with any applicable accessibility law or regulation. Customers with legal compliance obligations are strongly encouraged to supplement use of the Tool with a qualified accessibility consultant or the Expert Accessibility Audit services described in the Accessibility Solution Terms.

6. CREDITS AND USAGE

Use of each Remediation Module consumes credits from the Customer’s account in accordance with the credit provisions of the Account Terms and the pricing then published for that Remediation Module. In addition to the general credit rules in the Account Terms, the following apply specifically to the Tool: (a) credits are deducted at the time an operation is processed, not at the time it is requested; (b) if an operation fails or cannot be completed due to a technical issue attributable to Leovoid, no credits will be deducted for that operation; (c) because each Remediation Module is metered independently, credit consumption, balance, and any applicable Auto-Reload configuration may be tracked and managed separately per Remediation Module, as reflected in the Customer’s account; and (d) if the credit balance applicable to a given Remediation Module is insufficient to complete a requested operation, that operation will not be processed and no change will be made to the Integration Target. The Customer must top up or renew the applicable credits to resume processing for that Remediation Module.

7. LIMITATIONS, LIABILITY, AND CUSTOMER RESPONSIBILITIES

The Customer is responsible for (a) having proper authorization to install and operate the Connector on the relevant Integration Target; (b) maintaining, updating, and backing up the underlying Integration Target; (c) reviewing changes made by the Tool where appropriate, particularly where the Integration Target involves custom code or complex integrations, including by obtaining an independent expert review after remediation is applied; (d) ensuring continued compatibility between the Integration Target (including its core software, theme or template, and any third-party plugins or extensions) and the Connector; and (e) manually completing any accessibility issue that the Tool identifies, proposes, or only partially remediates, where full resolution requires action beyond what the Tool applies automatically.

Changes made to the Customer’s Integration Target through use of the Tool are made at the Customer’s direction, as configured through the Customer’s account. Except as expressly provided in the Account Terms, Leovoid is not liable for such changes, including any unintended visual, functional, or content consequence resulting from them. This Section does not limit the Customer’s ability to obtain an independent review of the Tool’s changes from a qualified accessibility expert, including through the Expert Accessibility Audit services described in the Accessibility Solution Terms, and Leovoid encourages such review as a matter of practice rather than obligation.

The Tool is designed and configured to prioritize accessibility compliance, not visual, layout, or design preservation. Where a compliant outcome requires a change to the Integration Target’s appearance, layout, or design, the Tool will apply that change on a compliance basis rather than a design-preservation or aesthetic basis. The Tool does not attempt to maintain the Customer’s existing design, nor to select the most visually preferable version of a compliant fix, and Leovoid is not liable for any resulting change in appearance, layout, or design.

Leovoid does not warrant that the Tool will resolve every accessibility issue on the Customer’s Integration Target, or that the Integration Target will meet any applicable legal or regulatory requirement as a result of using the Tool. The Tool is one component of a broader approach to accessibility, and its automated output does not substitute for professional judgment on issues that require it.

8. DATA COMMUNICATED BY THE CONNECTOR; SECURITY

To provide its functionality, the Connector communicates certain information from the Integration Target to the TenthLoop platform, including (a) content and structural markup relevant to the active Remediation Modules; (b) the Integration Target or account identifier and authentication credentials linking the installation to the Customer’s TenthLoop account, including any login credentials provided under Section 4; and (c) usage and activity data required for credit tracking, billing, and reporting.

All communication between the Connector and the TenthLoop platform occurs over encrypted connections. Authentication and login credentials issued to or provided for the Connector are stored within the Customer’s own installation, or otherwise secured, and are not exposed publicly. Only users with administrative privileges over the Integration Target may configure the Connector or manage its credentials.

9. UPDATES AND CHANGES

Leovoid may release updates to the Connector to introduce new Remediation Modules, improve existing functionality, or address security issues. Leovoid recommends keeping the Connector updated. Leovoid may modify or discontinue features of the Tool, including individual Remediation Modules, with reasonable notice, consistent with its ongoing development of the platform.

In addition to modifying, deprecating, or retiring individual Remediation Modules, Leovoid may discontinue the Tool in its entirety, subject to the Marketplace tool discontinuation provisions of the Account Terms.

10. RELATIONSHIP TO OTHER TERMS

This Tool Addendum is incorporated into, and should be read together with, the Accessibility Solution Terms and the applicable Service Terms Schedule. Defined terms used but not defined in this Tool Addendum have the meanings given to them in the Account Terms and the Accessibility Solution Terms. For terms governing credits, billing, and the Marketplace generally, refer to the Account Terms.
